Terms of  Sales

 

Acceptance of Orders

Your receipt of an electronic or other form of order confirmation from Wakky Shirts does not constitute an acceptance of your order, nor does it provide confirmation of our agreement to sell.  We reserve the right, at any time after receipt of your order and without prior notice to you, to supply less than the quantity you ordered of any item.  We may require additional authorizations, verifications or other credit information before accepting any order.  We reserve the right to accept or decline any order for any reason.

Backorders

If your order is not is stock, the product will be placed on backorder and shipped when the item is available.  You may cancel a backorder at any time prior to shipping by calling our Customer Service number.

PAYMENT METHODS

Credit Cards

We accept Visa and MasterCard and there is no surcharge for using your credit card to make purchases on this site.  Please be sure to provide your exact billing address (as listed by the issuing bank) and telephone number.  Incorrect information may cause a delay in processing your order.  The charge on your credit card will be processed at the time your purchase is ready for shipment.

Checks & Money Orders

We accept money orders, cashiers checks, and company checks in U.S. Dollars only.  Orders are processed upon receipt of a money order or cashier’s check.  For company checks, please allow up to 15 banking days after receipt for clearance of funds before the order is processed.  We cannot guarantee the availability of a product or price by the time funds clear or payment is received.  A $35 fee is charged for all returned checks.

Please make sure your order number is written on all payments.  We also suggest sending the payment via a method that provides tracking of deliveries (i.e. UPS, or Federal Express)

Damaged Merchandise

If a product appears to be damaged at the time of delivery, it is best to REFUSE delivery and give it back to the carrier attempting delivery.  If you accept the damaged package make sure it is noted on the carrier’s delivery record, in order for us to file a damage claim. Save the merchandise AND the original box and packing it arrived in.  Notify us immediately to arrange for a carrier inspection and a pick up of damaged merchandise.  If you do not notify us of damaged goods within 15 days of delivery, our regular return policy will override any claim of damage, and the product will fall under all current manufacturing restrictions.

Product Pricing

All prices are subject to change without notice and will be established at the time of order acceptance by us.  Order acceptance and sale by us occurs at the time of shipment.  Prices for backordered products are not guaranteed.

RETURN POLICY

Please contact our Customer Service Department before you make a return.  No returns will be accepted without a valid accompanying authorization number and a copy of the original invoice. 

General Return Policy

Merchandise in new condition can be returned within 3 days of receipt.   Please contact us for an Return Material Authorization prior to returning your items, to insure proper credit and follow the Return of Products Instructions below.  The RMA is valid for 10 days from date of issuance.  Returns will not be accepted without an RMA.  Manufacturer restrictions do apply.  Any item missing the UPC cannot be accepted for return.

A defective product can be returned within thirty (30) days of the invoice date for: credit, replacement, exchange or repair (at our discretion). To return a defective product, please contact our Customer Service Department for a Return Merchandise Authorization (RMA) number.

Return of Non-Defective Products

A non-defective product can be returned to us within thirty (30) days of the invoice date for : credit or exchange (at our discretion).  All non-defective returns are subject to a 25 percent (25%) restocking fee.  To return a non-defective product, please contact our Customer Service Department for a Return Merchandise Authorization (RMA) number and follow the Return of Products Instructions below.  The RMA is valid for 10 days from date of issuance.  Returns will not be accepted without an RMA.  Manufacturer restrictions do apply.  Any item missing the UPC cannot be accepted for return.  After thirty (30) days, only manufacturers’ warranties apply.

Cancellation of Order / Refusal of Shipment

Once an order for any product has been processed (payment has been processed and the order placed with the supplier), a non-refundable processing fee of five percent (5%) will be charged to the customer if the order is cancelled prior to being shipped or if delivery of the product is refused after the product has been shipped.

Return of Products Instructions

Once you have received your RMA number as covered above,  please follow these instructions when sending your original item back:

-         All products must be 100% complete and in original condition with all original packing material and boxes (with original UPC codes on manufacturer boxes), manuals, software, blank registration and warranty card(s) and all other accessories and documentation provided by the manufacturer.

-         The RMA number must appear on your return packing label.  Please do not write on the outside of the product’s box.  The RMA number is good for only one (1) item and must match the product authorized for return.  Returns will not be accepted without an RMA.

-         Return your package to the address given to you by our Customer Service department when you received you RMA number.  You must send your package(s) via UPS, Federal Express, or other delivery service with tracking information. 

-         It is strongly recommended that you fully insure your return shipment in case it is lost or damaged, and that you use a carrier that can provide proof of delivery for your protection.

-         You must submit tracking numbers for every package shipped to our returns department.

-         Remember to include your packing slip from the original order.

-         All shipping and handling on returned products must be prepaid by the customer.

Note:  The original item(s) must be received within 10 business days of receipt of your RMA.  Any discrepancies could result in a delay or complete forfeiture of your credit.

SERVICE AND SUPPORT

All requests for technical service and support should be made directly to the manufacturer in accordance with their terms and conditions.

TAX

The purchaser is responsible for all applicable federal, state, municipal and other government taxes.  Unless otherwise specified, prices do not include such taxes.  Sales tax will be added to all orders to be delivered to addresses within the state of Washington.  Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Sales Tax will always be calculated at the end of the checkout.

TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we retain the right to refuse or cancel any orders placed for product listed at the incorrect price.  We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.  If your credit card has already been charged for the purchase and your order is canceled, we will immediately issue a credit to your credit card account in the amount of the purchase price.

WARRANTIES

Product warranties, if any, are provided by the manufacturer or publisher of the products.  If you are returning or replacing merchandise more than thirty (30) days after the date of invoice, you will need to contact the manufacturer directly.  After 30 days, only manufacturers’ warranties apply.  Manufacturers’ warranties vary on each product.  Extended warranties are available directly from select manufacturers.  Manufacturer information is subject to change without notice.

Every effort has been made to ensure the accuracy of all information on this web site.  However, we make no warranty expressed or implied with respect to the accuracy of the information, including prices, product editorials, product specifications or advertising.

We expressly disclaim all warranties either expressed or implied including the warranty of merchantability or fitness for a particular purpose.  This disclaimer in no way affects the terms of the manufacturer’s warranty, if any.  Title to goods being purchased is retained by us until the goods are paid for by the purchaser.  If goods are being purchased for export, it is the purchaser’s responsibility to obtain export documentation from the Federal Government before shipping goods to a foreign country.  In addition, manufacturer’s warranties may vary or be voided upon export of those goods.  If you have any questions, please check with the manufacturer prior to purchase.

JURISDICTION

Wakky Shirts is a Washington company and you agree that any legal action brought against Wakky Shirts shall be governed by the laws of the state of Washington without regard to its conflict of law principles.  Additionally, you agree that any and all disagreements arising from your use of  or orders placed through wakkyshirts.com will be adjudicated in the county of Snohomish, Washington by an appropriate federal or state court.
